CICO - Terms and Conditions

EFFECTIVE DATE: January 13th, 2025

Thank you for your interest in our mobile money and remittance service, Commerce 360 Inc., doing business under the trade name CICO Cash. PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING OUR PRIVACY POLICY (COLLECTIVELY, THE “TERMS”). IF YOU DO NOT AGREE, YOU SHOULD NOT USE THE PLATFORM.


Consumer Fraud Alert

Protect yourself—be cautious of fraud tactics. Be wary of sending money to strangers, responding to unsolicited messages, or unfamiliar offers. Notify us immediately if your CICO Cash login credentials have been compromised.

1. Contract Formation and Overview

1.1 These Terms govern your access to and use of the website, mobile app, and related services (collectively, the “Service”). By using the Service, you agree to these Terms.

1.2 References to CICO Cash, we, us, or our denote Commerce 360 Inc., including its employees, directors, affiliates, successors, and assigns.

1.3 Terms like you or your refer to users of the Service—both senders and recipients.

1.4 These Terms are effective as of the date above and may change over time. New versions will apply only from their effective date onward.

1.5 The Service is designed for sending and receiving money—including P2P transfers, cash-in/cash-out with agents, bill payments, virtual card issuance, and more. Always only send money to people you know and trust.

3.1 We will provide the Service with reasonable care and effort.

3.2 We may refuse or limit transactions at our discretion, including for compliance with laws (e.g., BSA/AML), and will notify you if we can't process a transaction.

3.3 We may modify, suspend, or discontinue any part of the Service at any time without notice.

3.4 Transaction delays may occur due to identity verification, funding method validation, or compliance checks.

3.5 We strive to provide accurate agent location and service information, but we aren’t liable for inaccuracies or related losses.

4. Your Obligations

By using the Service, you agree to:

4.1 Be at least 18 years old and legally capable of forming a binding contract.

4.2 Provide accurate and updated personal information, including identity verification when required.

4.3 Use valid payment instruments and ensure sufficient funds for transactions.

4.4 Check all transaction details before submission—changes post-submission are typically not possible.

4.5 Be responsible for any fees imposed by your financial institution (e.g., overdraft, card fees).

4.6 Only send money to trusted individuals, not for purchasing goods or services (or using the service for third-party payments).

4.7 Transact on your own behalf unless prior approval has been obtained for business or entity use.

4.8 Comply with applicable laws and do not use the Service for illegal activity (e.g., fraud, money laundering).

4.9 Maintain the security of your login credentials and not share them or use bots to access the Service.

5. Cancellation and Refunds

5.1 If you encounter any issues, contact our support team (details in Section 16).

5.2 You may cancel a transaction within 30 minutes unless funds have already been delivered or picked up.

5.3 To dispute or report an error, contact us within 180 days with detailed information. We'll investigate within 90 days and update you within three business days.

5.4 Refunds are credited to the original payment source, same currency. No adjustment for exchange rate fluctuations.

5.5 For duplicate transactions, we may refund the amount (minus banking or processing costs) at our discretion.

5.6 Unauthorized use of another person’s card will be investigated and refunded per our protocols.

6. Information Collection

6.1 We comply with identification regulations as required and may verify your identity with third-party sources.

6.2 You consent to data processing for KYC, compliance, and customer support, as detailed in our Privacy Policy.

6.3 We may be required by law to share your information with regulatory authorities.

7. Intellectual Property

All content, trademarks, and intellectual property on the CICO Cash platform are owned by Commerce 360 Inc. or its licensors. You may only view and copy content for personal use—no duplication, distribution, or commercial use without permission.

8. Disclaimer of Warranties

The Service is provided "as is," without any warranties. To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for purpose, and non-infringement.

9. Limitation of Liability

Our liability (and that of our affiliates) is limited to $500 plus any refunded transaction amount/fees. We’re not liable for indirect, consequential, or special damages—even if advised of the possibility.

10. Electronic Communications

10.1 We may communicate electronically for all notices, disclosures, or transaction records.

10.2 You agree to electronic delivery and must access electronic communications (with a suitable browser, email, etc.) to maintain the Service.

10.3 Your login (email or Phone) and password serve as your electronic signature.

11. Termination

11.1 Both you and CICO Cash may terminate these Terms with one day's notice.

11.2 Immediate termination may occur if you breach these Terms, become insolvent, or compromise platform security.

12. Complaint Resolution

Refer to Section 5 for disputes. If unresolved, regulatory complaint information is available as required. You may escalate to governing authorities as necessary.

13. General Provisions

13.1 Governing law: These Terms are governed by Delaware law, and disputes will be handled in Delaware courts.

13.2 No waiver: Failure to enforce a right does not waive it.

13.3 Amendments: We may modify these Terms—continued use implies acceptance of changes.

13.4 Entire agreement: These Terms constitute the full agreement between you and CICO Cash.

13.5 Severability: Invalid provisions don’t invalidate the rest of the Terms.

13.6 External links: We’re not responsible for third-party content or websites linked from the Service.

14. Security

We use advanced encryption, secure storage, biometric and PIN security (e.g., fingerprint, Face ID), plus real-time fraud monitoring to keep your funds and account safe.

15. Third-Party Services

Where applicable, we may integrate with third-party platforms (e.g., payment processors, API integrations). We are not responsible for how these third parties handle your data or service.
